The Inspector-General of Police, Alkali Baba Usman, has said that police are protected under the constitution to investigate and prosecute the suspended Chairman of Kano State Public Complaints and Anti-Corruption Commission, Muhuyi Rimin-Gado, following criminal allegation brought against him. He made the submission, yesterday, before Justice Jane Inyang of the Federal High Court sitting in Kano.
The IGP, who affirmed the police investigation over alleged forgery of the medical certificate Rimin-Gado submitted to Kano State House of Assembly, insisted that such process had not violated the fundamental right of the former chairman of the anti-graft agency.
Similarly, the Speaker, Kano State House of Assembly, Hamisu Ibrahim Chedari and the state’s Attorney-General and Commissioner for Justice, Musa Abdullahi Lawan, have urged Justice Inyang to refuse the application filed by Rimin-Gado.
Rimin-Gado, who was suspended as chairman of the commission, had on October 12, 2021 filed an ex-parte application for an interim injunction restraining the IGP and Commissioner of Police in Kano from investigating, arresting or intimidating him.
The former chairman of the anti-graft commission, through his counsel, S.A. Danazumi, also joined the Speaker of the House of Assembly, as well as Accountant-General of Kano State, from using the IGP and CP to investigate, arrest or intimidate him.
At the resumption of hearing on the application yesterday, counsel to the IGP and CP, Superintendent of Police S.O. Ekwue, argued that the applicant had not established any evidence to prove an infringement on his right.
Ekwue affirmed the legal authority bequeathed the police under the law to investigate suspect and prosecute where necessary.
Although Danazumi argued that police action contravenes the order of Kano State High Court on the subject matter, counsel to the police insisted that while the earlier matter dwells on allegation of misconduct and misappropriation, the matter before the court basically concerns forgery of medical certificate.
Ekwue, therefore, urged the court to dismiss the application to enable the police continue and conclude investigation against Rimin-Gado.
On his part, counsel to first, second, third and fourth respondents, W.A. Wada, equally urged the court to refuse the application. However, Justice Inyang stood the matter down for judgment on January 28, 2022.
